These Terms and Conditions govern the ‘Moonpig x Disney Parks’ prize draw run by Moonpig.com Limited . Please read them carefully. By entering into the Prize Draw, all Participants are deemed to have read, accepted and agreed to be bound by these Terms and Conditions.
DEFINED WORDS: In these Terms and Conditions, a bold or capitalised word has a particular meaning. These relevant words can be found in brackets after their meaning. Any reference in these Terms and Conditions to “we”, “us” or “our” is a reference to Moonpig. Any reference to “you” or “your” is a reference to any Participant of the Prize Draw and these references may be used interchangeably.
The Parties:
The promoter is Moonpig.com Limited of Herbal House, whose registered office is at 10 Back Hill, London, England, EC1R 5EN (Moonpig).
A participant refers to any entrant of the Prize Draw (the Participant(s)).
The Prize Draw:
The title of this Prize Draw is “Moonpig x Disney Parks September Prize Draw” (the “Prize Draw”).
The promotion is open from 00:00 GMT 06.09.2023 (the “Opening Date”) until 23:59 GMT 15.10.2023 (the “Closing Date”).
Entry Mechanics:
To enter the prize draw ensure you have completed the entry form at the URL: https://link.moonpig.com/join/disney-parks-partnership-opt-in and click the Enter button.
Moonpig may change dates referred to in these Terms & Conditions where, at Moonpig’s sole discretion, such a change is reasonably necessary. Such changes will be notified on Moonpig’s website or social media pages such as Instagram or Facebook (“Social Media Pages”)
Moonpig accepts no responsibility for Prize Draw entries not successfully completed or not received by Moonpig due to a technical fault or technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
Participants are limited to one (1) entry per customer account. All subsequent entries will be disregarded.
You must not create multiple email accounts in order to enter the promotion more than once per person. Any entrant found to be using multiple accounts to enter the promotion or using automated entries or other programmes will be found in breach of these terms and excluded from the promotion, and all such entries will be disqualified. If you are selected as a winner and the Promoter subsequently discover that you have entered multiple times, the Promoter reserve the right to withdraw the prize.
Eligibility
To be eligible to enter into the Prize Draw, Participants must be UK residents aged 18 years or over.
Participants must not be employees or associated persons of Moonpig or Disney or its affiliated companies, agents or any third party directly associated with administration of the Prize Draw, and this also includes members of their immediate families and households.
In entering the Prize Draw, all Participants confirm that they meet the eligibility requirements under these Terms and Conditions and are eligible to claim any Prize they may win.
Moonpig may reasonably require all Participants to provide proof that they meet the eligibility requirements for this Prize Draw.
Moonpig reserves the right to disqualify any Participants if Moonpig believes, at its sole discretion, that any Participant’s conduct is contrary to the spirit or intention of the Prize Draw.
The Prize:
There will be a total of 1 (one) winning Participant in this Prize Draw (referred to as the “Winner”).
The Prize Draw is being run by Moonpig as the Promoter.
Disney will provide the Promoter for the promotion Moonpig X Disneyland Paris (the “Promotion”) with one (1) package holiday consisting of two (2) night, three (3) day to Disneyland Paris for one (1) winner of the competition (Recipient) and three (3) accompanying guests, in total four (4) persons.
The prize includes:
Return transport to Disneyland Paris, travelling by Eurostar in Standard class to Disneyland Paris from London St Pancras, or an economy class return flight from a selected regional airport to Paris Charles de Gaulle.
Return transfers between the Charles de Gaulle/Orly airport or Gare du Nord and Disneyland Paris.
Two (2) nights’ accommodation sharing one (1) standard room by the Recipient and three accompanying guests, including continental breakfast.
Three (3) Day Park Hopper ticket per winner and accompanying guest valid for entry into the Disneyland Park and Walt Disney Studios Park.
Half board premium meal vouchers to cover lunch and dinner for four (4) people for the duration of the three (3) day trip.
The Prize consists only of the elements expressly set forth above.
Items not included which are the responsibility of the Recipient and accompanying guests include: UK transfers, alcoholic beverages, telephone charges, room service, laundry service, excursions, tips, souvenirs, and all other costs not otherwise mentioned herein.
The Prize is for the Recipient and up to three (3) guests of the Recipient’s choosing.
Travel insurance is not included. It is the Recipient’s and their guests’ responsibility to take out before travelling adequate insurance suitable for their needs for the entire duration of the Prize. Disney shall not be liable for any costs or losses through the Recipient’s failure to take out adequate insurance cover.
The holiday must be taken between 15 December 2023 – 30 September 2024. The set weekend travel dates are subject to change. The booking form must be received back a minimum of 60 days before the travel dates.
The Recipient and all of their guests must travel at the same time on the same routing. Any children in the group must be accompanied by their parent/legal guardian aged 18 or over.
The Recipient and their guests are responsible for their own passport, visa requirements and any other documentation or any other requirements (including but not limited to Covid -19 testing) that may be imposed by the authorities from time to time.
It is the Recipient and their guests responsibility to comply with the applicable laws and follow the Foreign Commonwealth and Development Office’s travel advice in respect of Covid-19 which can be found at https://www.gov.uk/guidance/travel-advice-novel-coronavirus.
Age and height restrictions may apply to some attractions. Parks, attractions and/or entertainment may change operating hours or be closed due to refurbishing, capacity, weather or special events and may otherwise change or be discontinued without any notice and without liability to the Supplier.
The Prize and all elements within may not be sold, traded, transferred, rescheduled to dates not within the fulfilment period set forth above, or refunded.
The Supplier reserves the right to substitute elements of the Prize at any time or postpone the trip, including but not limited to due to closure of Disneyland Paris or any unavoidable and extraordinary circumstances.
There is no alternative prize and the Prize cannot be exchanged for cash or an alternative prize.
If the winner elects to partake in any or all portions of his/her prize with fewer than three (3) guests, the prize will be awarded to the winner and any participating guest and any remainder of the prize will be forfeited and shall not be subject to further or alternative compensation.
Enhanced health and safety measures will be/are in place at Disneyland Paris to promote cleanliness, physical distancing and reduced contact. Some experiences, shows or events may not be available or may be modified depending on the evolution of the safety and sanitary measures and recommendations from public authorities or other reasons, including but not limited to adverse weather conditions, refurbishment or maintenance. Some hotels may be closed during some or all arrival period. Details available at DisneylandParis.com.
Disney, its parent, related, affiliated, and subsidiary companies and their respective officers, directors agents, employees and assigns shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or in any way related to the Prize, the receipt, use and/or enjoyment of the Prize and/or the Promotion.
By participating in the Promotion Recipients and their guests agree that they will be subject to Disneyland Paris Booking Terms and Conditions save for the sections relating to the fees of booking. Full Terms and Conditions can be found here.
Moonpig reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond Moonpig's control make it necessary to do so.
The Prize Draw Winner:
Moonpig will solely decide who the Prize Draw Winners shall be, and this decision shall be final and binding and no correspondence or discussion will be entered into.
All Winners will be randomly selected by a random number generator (and this will be overseen by an impartial adjudicator) on or around 16.10.2023 (the “Announcement Date”).
Moonpig will announce the Winners by emailing Winners via the email address used to enter the prize draw (the “Prize Notification”).
Moonpig is required either to publish or make available information that indicates a valid award took place. To comply with this obligation, Moonpig may publish each Winner’s name (only first name and first initial of their surname) on Moonpig's Social Media Pages and e-mail campaigns on or after the Announcement Date.
If any Winner objects to any or all of its social media details and winning entry being published, that particular Winner must contact Moonpig via private message on Moonpig’s Social Media Page as soon as it receives the Prize Notification or via email to [email protected].
Notwithstanding the above, Moonpig must still provide the information and details of any and all winning entries and the Winners to the Advertising Standards Authority and any other regulatory or legal body upon reasonable request.
Claiming the Prize:
The Winner will have 5 (five) days from the date of the Prize Notification to claim the Prize, and to provide the information requested by Moonpig which shall include but is not limited to the postal address, phone number, and any other information reasonably required by Moonpig (the “Relevant Information”), using the method specified in the Prize Notification.
In the event the Winner does not wish to accept the Prize or fail to confirm their acceptance of the Prize or does not provide the Relevant Information for the purpose of delivering the relevant Prize within the timeframe stated in paragraph 1 of section F of these Terms, that Winner will be deemed to have automatically forfeited the Prize and shall have no recourse against Moonpig in any manner, including by not limited to in relation to these Terms and Conditions, the Prize or Prize Draw. Moonpig shall then arrange for another eligible Participant to be selected in accordance with the process outlined in Section D of these Terms and this Participant shall be considered the Winner of the Prize Draw. For the avoidance of doubt there shall be a maximum of 12 (twelve) Winners of this Prize Draw at any time.
Under no circumstances may the Prize be claimed by a third-party on the Winner’s behalf.
Limitation of liability:
Insofar as is permitted by law, Moonpig, Disney Parks its agents or distributors will not in any circumstances be responsible or liable to compensate any Winner or accept any liability for loss, damage, personal injury or death occurring as a result of taking up the Prize, particularly when it is caused by negligence, wilful misconduct or concealment of the Relevant Information by any Winner (deliberate or otherwise).
Paragraph 1 of section F of these Terms shall not apply where loss, damage, personal injury or death is caused by the negligence of Moonpig, its agents or distributors or that of their employees. A Participant’s statutory rights are not affected.

By entering the Prize Draw all Participants consent to the use of their personal data by the Moonpig for the purposes stated in these Terms & Conditions.
If you win the competition, we will pass your contact details to Disney in order for Disney to arrange the prize with you and, by entering into this competition, you acknowledge that this is necessary for us to fulfil our contractual obligations.

General
If there is any reason to believe that there has been a breach of these Terms and Conditions, Moonpig may, at its sole discretion, reserve the right to exclude any individual from participating in the Prize Draw.
Moonpig reserves the right to hold, void, suspend, cancel, or amend the Prize Draw where it becomes necessary to do so.
If any part of these Terms and Conditions is held to be invalid or unenforceable, the remainder shall remain valid and enforceable.
Moonpig’s failure to act with respect to a breach of these Terms and Conditions does not constitute a waiver of its rights to act with respect to subsequent or similar breaches.
The headings in these Terms and Conditions are for ease of reference only and do not affect the interpretation or construction of these Terms and Conditions.
Governing law and jurisdiction
These Terms and Conditions shall be governed by English law and all parties to these Terms and Conditions submit to the exclusive jurisdiction of the courts of England and Wales.

All Prize Draw entries are free of charge and no qualifying purchase is necessary.

For the avoidance of doubt there shall be a maximum of 10 (ten) Winners of this Prize Draw at any time.
Under no circumstances may the Prize may be claimed by a third-party on a Winner’s
behalf.
Limitation
of
liability:

B. Entry Mechanics:
⦁All qualifying purchases of a standard-sized card sold on the Moonpig UK website (Website), or the official Moonpig phone application (App) purchased pursuant to the Moonpig consumer Terms and Conditions found at https://www.moonpig.com/uk/terms-and-conditions/ (as amended from time to time) will be automatically entered into the Prize Draw between 00:00 GMT 1.02.2023 (the “Opening Date”) to 23:59 GMT 12.02.2023 (the “Closing Date”).
⦁A qualifying purchase is required in order to enter into the Prize Draw this shall refer to a purchase of a standard sized card for personal use on the Moonpig App or Website. For the avoidance of doubt any other purchase on the Moonpig Website or App shall not qualify as a qualifying purchase for this Prize Draw.
⦁Moonpig may change dates referred to in these Terms & Conditions where, at Moonpig’s sole discretion, such a change is reasonably necessary. Such changes will be notified on Moonpig’s website or social media pages such as Instagram or Facebook (“Social Media Pages”)
⦁Moonpig accepts no responsibility for Prize Draw entries not successfully completed or not received by Moonpig due to a technical fault or technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
⦁Participants are limited to one (1) entry per customer account. All subsequent entries will be disregarded.
⦁All Participants must still have a valid and unrestricted Moonpig account on the Announcement Day (defined below) in order for their entry to remain valid.
C. Eligibility:
⦁To be eligible to enter into the Prize Draw, Participants must be UK residents aged 18 years or over.
⦁Participants must not be employees or associated persons of Moonpig or its affiliated companies, agents or any third party directly associated with administration of the Prize Draw, and this also includes members of their immediate families and households.
⦁In entering the Prize Draw, all Participants confirm that they meet the eligibility requirements under these Terms and Conditions and are eligible to claim any Prize they may win.
⦁Moonpig may reasonably require all Participants to provide proof that they meet the eligibility requirements for this Prize Draw.

⦁ The Prize consists only of the elements expressly set forth above.
⦁ Participants hereby agree to be bound to any terms and conditions as stipulated by Red Letter Days (“Red Letter Days”) who shall act as the Prize provider and found at https://www.redletterdays.co.uk/terms (as amended from time to time). Participants agree that to redeem any Prize, they may be required to register as a Red Letter Days customer.
⦁There is no cash alternative for the Prizes. Prizes can be exchanged via the Red Letter Days website if the winner would prefer a different experience of the same value.
⦁If a Winner(s) elects not to partake in any or all portions of the Prize, any remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation. The Prize may not be sold, offered for sale or used in connection with any other Prize Draw or promotion by the Winner(s).
⦁The Prize Draw is being run by Moonpig as the Promoter.
⦁If applicable, Moonpig will not deliver to any address outside the United Kingdom.

⦁Moonpig strongly encourages safe and responsible drinking at all times and does not condone excessive drinking under any circumstances.
E. The Prize Draw Winner:
⦁Moonpig will solely decide who the Prize Draw Winners shall be, and this decision shall be final and binding and no correspondence or discussion will be entered into.
⦁All Winners will be randomly selected by a random number generator (and this will be overseen by an impartial adjudicator) on or around 13.2.2023 (the “Announcement Date”).
⦁Moonpig will announce the Winners by emailing Winners via the email linked to their Moonpig customer account (the “Prize Notification”).
⦁Moonpig is required either to publish or make available information that indicates a valid award took place. To comply with this obligation, Moonpig may publish each Winner’s name (only first name and first initial of their surname) on Moonpig's Social Media Pages and e-mail campaigns on or after the Announcement Date.
⦁If any Winner objects to any or all of its social media details and winning entry being published, that particular Winner must contact Moonpig via private message on Moonpig’s Social Media Page as soon as it receives the Prize Notification or via email to [email protected].
⦁Notwithstanding the above, Moonpig must still provide the information and details of any and all winning entries and the Winners to the Advertising Standards Authority and any other regulatory or legal body upon reasonable request.
F. Claiming the Prize:
⦁Each Winner will have 3 (three) days from the date of the Prize Notification to claim the Prize, and to provide the information requested by Moonpig which shall include but is not limited to the postal address, phone number, and any other information reasonably required by Moonpig (the “Relevant Information”), using the method specified in the Prize Notification.
⦁In the event a Winner does not wish to accept the Prize or fail to confirm their acceptance of the Prize or does not provide the Relevant Information for the purpose of delivering the relevant Prize within the timeframe stated in paragraph 1 of section F of these Terms, that particular Winner will be deemed to have automatically forfeited the Prize and shall have no recourse against Moonpig in any manner, including by not limited to in relation to these Terms and Conditions, the Prize or Prize Draw. Moonpig shall then arrange for another eligible Participant to be selected in accordance with the process outlined in Section E of these Terms and this Participant shall be considered a Winner of the Prize Draw. For the avoidance of doubt there shall be a maximum of 12 (twelve) Winners of this Prize Draw at any time.
⦁Under no circumstances may the Prize be claimed by a third-party on a Winner’s behalf.
